Privacy Policy

Version 2026-11-03. This Policy covers the utiliflex.com website and its contact form. Data processed inside the Juice platform for utility clients is governed by each client’s Statement of Work.

This Privacy Policy explains how Utiliflex, LLC (“Utiliflex,” “we” or “us”) collects, uses and shares information when you visit the website at utiliflex.com and its subdomains (the “Website”) or contact us through it. We are the controller of personal information collected through the Website. Our address is 1100 Market Street, Suite 907, Chattanooga, TN 37402, USA.

1. Scope

This Policy covers the Website only. It does not cover data processed within the Juice software platform on behalf of utility clients — for example, utility customer accounts, meter data or payment records. That data is processed under the applicable Statement of Work and End-User License Agreement, in which the utility is the controller and Utiliflex acts on its instructions.

2. Information We Collect

Information you give us. When you submit the contact form we collect the information you enter: your name, work email address, organization, country, your area of interest and deployment preference, and the text of your message. Providing this information is voluntary; without it we cannot respond to your enquiry.

Mobile numbers for SMS. If you opt in to receive demonstration or test messages from the Juice platform — directly with us, or by enrolling in a prepay service with a participating utility that passes your number to the platform — we collect your mobile number, the date, time and method of your consent, and the messages sent to you. See Section 4.

Information collected automatically. Our hosting and security providers process standard technical data when you visit the Website: IP address, browser and device type, pages requested, referring page, and timestamps. Bot-protection on the contact form may also evaluate browser signals to distinguish people from automated traffic. We use Cloudflare Web Analytics, a cookieless, privacy-preserving measurement tool that records aggregate page views and visitor country without identifying individuals. We do not run advertising or cross-site tracking scripts.

3. How We Use Information

We use contact-form information to respond to your enquiry, to evaluate and follow up on a potential engagement, and to keep a record of our correspondence. We use technical data to operate, secure and troubleshoot the Website and to prevent abuse of the contact form. We do not sell personal information, and we do not use Website data for advertising.

Our legal bases, where required, are: performance of pre-contractual steps you request (responding to an enquiry); our legitimate interests in operating and securing the Website and in marketing our services to business contacts; and consent, where we ask for it.

4. SMS Messaging and Mobile Numbers

Utiliflex operates an SMS program, “Utiliflex Juice Notifications”, used only to demonstrate and test transactional account notifications from the Juice platform (top-up receipts, low-balance alerts, disconnection and reconnection alerts, replies to account-service requests you send by text such as balance requests or contact-detail updates, enrollment invitations, and password-reset or verification codes you request). We send such messages only to people who have opted in. We do not send marketing SMS. Full program terms, including how to opt out (reply STOP) and get help (reply HELP), are in our Website Terms of Use, Section 6.

Mobile numbers are used solely to deliver the messages you asked for, to respond to balance requests and contact-detail updates you text to us, to deliver password-reset and verification codes, and to keep a record of your consent and opt-out. We will not share your mobile number or your opt-in to an SMS campaign with any third party or affiliate for marketing purposes, or for any purpose unrelated to providing you with the services of that campaign. Mobile opt-in data is not sold, rented or exchanged. Messages are transmitted through Twilio, Inc. acting as our messaging service provider, which processes numbers only to deliver messages and to honor STOP/HELP requests.

Production notifications sent by a utility to its own customers are sent by that utility through its own messaging gateway; Utiliflex does not send those messages, and the utility’s privacy policy governs them.

5. Service Providers

We share information with service providers who process it on our behalf and under our instructions: Cloudflare, Inc. (website hosting, content delivery, network security, bot protection on forms, and cookieless web analytics); and Google LLC (Google Workspace — delivery and storage of contact-form submissions as email); and Twilio, Inc. (delivery of SMS messages in the demonstration program described in Section 4). We may also disclose information where required by law, to protect our rights or the safety of others, or in connection with a merger, acquisition or sale of our business. We do not otherwise share personal information with third parties.

6. International Transfers

Utiliflex is located in the United States and the Website is operated from there. If you contact us from outside the United States, your information will be transferred to and processed in the United States, where data-protection laws may differ from those in your country. Our service providers may process data in other countries as part of their global infrastructure. Where required, we rely on the providers’ standard contractual safeguards for such transfers.

7. Retention

SMS opt-in records (number, consent date and method, opt-out) are kept for as long as you remain opted in and for a period afterwards sufficient to demonstrate consent if required. Contact-form submissions are kept as business correspondence for as long as reasonably needed to handle the enquiry and any resulting relationship, and in any case no longer than necessary for the purposes described above or as required by law. Technical logs held by our hosting provider are retained for short periods according to that provider’s settings.

8. Cookies and Similar Technologies

The Website does not set advertising or analytics cookies; Cloudflare Web Analytics operates without cookies. Our hosting and bot-protection provider may set strictly necessary cookies or use browser storage to deliver the site securely and to verify that a form submission comes from a person. These are essential to the operation of the Website and cannot be disabled through the Website itself; you may block them in your browser, which may prevent the contact form from working.

9. Your Rights and Choices

Depending on where you live, you may have the right to access the personal information we hold about you, to have it corrected or deleted, to restrict or object to its processing, to receive a copy of it, and to lodge a complaint with a supervisory authority. To exercise any of these rights, email [email protected]. We will verify your request and respond within the time required by applicable law. You may ask us at any time to stop contacting you. To stop SMS messages, reply STOP to any message.

10. Security

The Website is served over HTTPS, and contact-form submissions are transmitted to us over encrypted connections. We restrict access to enquiry information to personnel who need it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children

The Website is directed at businesses and utility professionals. It is not intended for children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.

12. Changes and Contact

We may update this Policy from time to time. The version date at the top of this page identifies the current version; material changes will be reflected there.
